Dashcams record footage that routinely captures other road users, pedestrians, and private property. Dashcam use for private vehicle owners

For private vehicle owners using a dashcam for personal road safety and accident evidence purposes, the ICO (Information Commissioner’s Office) confirms that dashcam recording for this purpose is generally consistent with UK data protection law under a legitimate interests basis. The footage is being recorded for road safety purposes, the recording is proportionate, and the public expectation of being filmed in a public road environment is established.

Private vehicle owners do not need to register with the ICO for dashcam use, nor do they need to display a notice informing other road users of recording. However, if footage is shared beyond the original road safety or insurance evidence purpose, for example posted to social media or shared with third parties, the same data protection principles apply to that sharing decision.

Footage of incidents should be retained only as long as necessary for the purpose for which it was recorded, typically until any insurance claim or police investigation is resolved. Dashcam use for fleet and business operators

Business fleet dashcam use is subject to more detailed GDPR compliance obligations. A Data Protection Impact Assessment (DPIA) may be required for large-scale fleet monitoring programmes.

Employee notification is mandatory. Workers must be informed that dashcams are fitted to company vehicles, what data is collected, how it is used, who has access, and how long it is retained. This notification should be provided in writing and form part of the employee’s contract or vehicle use policy.

Interior driver-facing cameras in company vehicles require a stronger justification than forward-facing road cameras. The ICO distinguishes between interior monitoring for transport safety purposes, which is more readily justified, and general surveillance of employees, which requires clearer legitimate interests.
